Terms and Conditions of Sale
Before proceeding with any purchase from this site, we ask that you read the following Terms and Conditions of Sale, please.
They form part of the contract between you and Wizard Models. Whilst they may seem
heavy handed or legalistic, they are not substantively different
from the standard Terms & Conditions of Sale applicable to goods sold by Wizard Models elsewhere, nor for that matter
any other retailer in the UK.
- Applicable legislation includes:-
- Sale of Goods Act 1979 (as amended)
- Consumer Protection (Distance Selling) Regulations 2000
Please note nothing contained in the following sections or elsewhere on this site affects your statutory rights as a consumer,
identified in the above or other pertinent legislation.
- In the case of any disagreement or formal grievance, the binding law applicable to any sale
shall be the law of England and Wales, the domicile of Wizard Models. No other legal jurisdiction
will be accepted.
- All goods remain the property of Wizard Models until such time as Wizard Models has received cleared funds
to the full value of the transaction.
- For new customers, we generally do not despatch goods until we have received notification from our bank that funds have
been credited to our account.
- Any goods offered for sale on these pages are merely that - offers. Any offers are 'Errors and
Omissions Excepted' (E & OE). We reserve the right to amend details of orders as required. If there is an
incorrectly described or priced item then Wizard Models reserves the right to refuse to supply that item.
- Wizard Models reserves the right to decline to trade with any person or organisation. We undertake to
inform any such person or organisation within 1 working day of the descision to refuse to supply. We will not give
grounds for refusal NOR will we enter into any correspondence concerning the matter.
- Delivery (Post and Packing) is charged on top of the cited prices. Orders to UK customers (including IoM and Channel Islands)
are sent by Royal Mail First Class post, and are charged at £3.00 per order, regardless of weight. Orders outside the UK are sent using Royal Mail's Small Packet Air Mail service which generally
takes between 3 and 10 days. It is charged at £0.75 plus the cost of postage, subject to a minimum charge of £3.00. Because of the way online credit card orders are processed, £5 will be added to orders for delivery in Europe, and £10 for orders to the rest of the world. Your card will then be refunded for the difference between this notional amount and the actual cost.
- If you provide a valid e-mail address with your order, we will undertake to inform you of any
problems or delays encountered prior to despatch.
- The usual order turnaround is one working day. However, we may be out of stock of a particular item, which does happen with some of more specialist items stocked. Such items will be sent at a later date, and you will only be charged once for postage. Please note we do
NOT cash cheques or charge credit until at least two-thirds of the order (by value) is ready for despatch.
- Wizard Models is the parent trading name of Model Signal Engineering, Sprat & Winkle, D.G. Couplings, 51L and Chowbent 4mm. All six organisations
are wholly owned by Andrew Hartshorne and in essence synonymous.
- Wizard Models is now VAT registered (GB 911 3584 42). For the convenience of the vast majority of our customers, all prices shown are
inclusive of VAT. Order processing on the website separates out the amount of VAT at the payment stage, and will be deducted for non-EU customers.
- Should goods be damaged in transit please inform Wizard Models as soon as possible,
preferably by phone (for UK customers) or by e-mail or fax, as this is a requirement of
our delivery contractor. We will normally resolve such damaged goods problems within 5 working days.
Please note this does not affect your statutory rights as a consumer.
- You have the right to cancel an order placed by post, fax, phone or electronically, for a full refund, from the point of ordering and up to 8 working days
after receipt of the goods. This right is subject to you:-
- informing Wizard Models at your earliest convenience in writing or by e-mail, but no later than 8 days after receipt.
You do not need to give reasons for cancellation, but it would help us to know what went wrong.
- bearing the costs of returning the rejected goods.
Refunds will be credited to your account within 30 days of notification of cancellation. Should you decline to return
the goods or request Wizard Models to arrange for collection, this cost will be deducted from your refund.
- Defective goods or goods supplied in error: Please contact us within 28 days of receipt and
we will arrange to resolve the problem within 5 working days of your notification. This may take the form
of an exchange, refund or credit note at your discretion. This guarantee applies only to products which are defective
OR supplied in error. It does NOT apply to goods bought in error. Refunds on defective or faulty goods
will include the purchase price and the reasonable cost of your returning the goods.
- Goods bought in error: After the expiry of the 'cooling off' period (up to 8 working days after delivery as mentioned above) goods may be returned, at Wizard Models' discretion.
Refunds may be in the form of a credit note or cash refund, again at Wizard Models discretion.
- Refunds: Agreed refunds will made to you within 30 days. Refunds on credit or debit
card purchases are credited to the the card account, otherwise by cheque or IMO. Note that refunds on
goods bought in error may take the form of a credit note against future purchases.
- We endeavour to respond to any complaints or queries you may have within 5 working days; in practice
this is normally by return.
